Welcome to CodeDuel. By accessing or using our platform, you agree to be bound by these Terms of Use.
1. Acceptance of Terms
By creating an account or using any of the services provided by CodeDuel (the "Platform"), you agree to comply with and be legally bound by these Terms of Use ("Terms") and our Privacy Policy. CodeDuel is a production skills assessment platform used by companies and candidates in the context of recruitment and skills development processes. If you do not agree to these Terms, you are not permitted to use the Platform.
2. Account Registration and Security
To access certain features of the Platform, you must register for an account. You agree to: (a) provide accurate, current, and complete information during the registration process; (b) maintain and promptly update such information; (c) maintain the security of your password and accept all risks of unauthorized access to your account; and (d) promptly notify us if you discover or otherwise suspect any security breaches related to the Platform.
3. User Conduct
You are solely responsible for your conduct while using the Platform. You agree not to:
- Use the Platform for any illegal or unauthorized purpose.
- Submit code that infringes upon the intellectual property rights of others or that you do not have the right to submit.
- Attempt to maliciously exploit the behavioural analysis system or any other assessment mechanism of the Platform.
- Interfere with or disrupt the integrity or performance of the Platform.
- Attempt to gain unauthorized access to the Platform or its related systems or networks.
4. User Content and Intellectual Property
CodeDuel Content: All materials on the Platform, including text, graphics, logos, icons, images, and software, are the property of CodeDuel or its licensors and are protected by intellectual property laws. You may not use, reproduce, modify, or distribute any CodeDuel content without our prior written permission.
User Submissions: You retain ownership of the code, CVs, and other content you submit to the Platform ("User Content"). However, by submitting User Content, you grant CodeDuel a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Platform and CodeDuel's (and its successors' and affiliates') business, including for promoting and redistributing part or all of the Platform.
5. Assessment Integrity and Behavioural Analysis
The Platform implements several mechanisms to guarantee assessment integrity: dynamic random question selection, behavioural monitoring during sessions (tab switches, atypical response speeds, suspicious patterns), calibrated time windows per question, and variant rotation for code challenges. In addition, Soft Skills Assessments are based on a behavioural analysis system (SJT methodology) that objectively evaluates users' interpersonal competencies. CodeDuel does not guarantee the absolute accuracy of behavioural scores. Users and sponsoring organisations are responsible for their own judgment and any decisions made based on these results.
5a. Behavioural Assessments (Soft Skills)
The results of Soft Skills Assessments — including situational scenario responses (SJT), scores per behavioural family, and the AI-generated behavioural profile — constitute personal assessment data. This data is processed exclusively for the purpose of skills evaluation. In a B2B context (a campaign initiated by a company), results are shared only with the sponsoring organisation, which acts as joint data controller for the data of its candidates or employees. The candidate is informed of this sharing before the assessment begins.
5b. Credit System
Credits are a digital unit of account providing access to assessments on the Platform. They do not constitute legal tender, have no intrinsic monetary value, and are not subject to any refund or exchange outside the Platform. Acquired credits have a limited validity period and are non-transferable between accounts. CodeDuel reserves the right to modify the rules governing the acquisition, use, and validity of credits with reasonable notice.
6. Subscription Terms (For Company Accounts)
Company accounts may require a paid subscription to access certain advanced Platform features, as detailed on our Pricing page. Transactions are processed under live production conditions. Subscription fees are billed in advance on a monthly or annual basis and are non-refundable except as required by law or as explicitly stated by CodeDuel. We reserve the right to change our subscription plans and pricing with reasonable notice.
7. Termination
CodeDuel may terminate or suspend your access to the Platform, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform will immediately cease.
8. Disclaimers
The Platform is provided on an "as is" and "as available" basis. CodeDuel expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the fullest extent permitted by applicable law, CodeDuel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Platform; (b) any conduct or content of any third party on the Platform.
10. Data Protection and GDPR
CodeDuel is committed to protecting your personal data and complying with applicable data protection laws, including the General Data Protection Regulation (GDPR). Our collection, use, and sharing of your personal information are described in our Privacy Policy, which is an integral part of these Terms. By using the Platform, you consent to such processing as described in our Privacy Policy.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of Tunisia, without regard to its conflict of law provisions.
These Terms are drawn up in French, English and Arabic. In the event of any discrepancy in interpretation between these versions, the French version shall prevail.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms.
13. Contact Information
If you have any questions about these Terms, please contact us at contact@codeduel.net.
